Scope

These Terms govern your use of the Diggr website, app, and community features, unless a more specific agreement applies to a particular service. By using Diggr, you agree to these Terms.

About Diggr

Diggr is a service for saving, organizing, and sharing app recommendations through crates and public profiles. Certain features may be available without an account, while community features require authentication.

Eligibility and acceptable use

You may use Diggr only in compliance with applicable law and these Terms. You must not misuse the service, interfere with its operation, attempt unauthorized access, introduce malicious code, scrape the service in a way that burdens the infrastructure, or use Diggr for unlawful, deceptive, abusive, infringing, or harmful purposes.

You are responsible for ensuring that your use of Diggr, including anything you publish, upload, or link, does not violate the rights of third parties or applicable law.

Accounts and access

Some Diggr features require an account. At the time of writing, account access may be provided through Sign in with Apple. You are responsible for maintaining control over the authentication method you use and for any activity carried out through your account.

You must provide accurate information where Diggr asks for it and keep your profile information reasonably up to date. Diggr may restrict or suspend access where there is a legitimate reason to do so, including suspected abuse, security risks, unlawful use, or violations of these Terms.

Profiles, crates, links, and uploads

Profiles are public by design. You decide which crates appear on your profile. You are solely responsible for the content you publish through your profile, including profile texts, links, profile images, crate names, crate descriptions, app snapshots, and other publicly visible information.

You may only upload, publish, or link content that you have the right to use. You must not publish content that is unlawful, misleading, defamatory, infringing, abusive, discriminatory, violent, sexually exploitative, or otherwise harmful.

Rights in your content

You retain any rights you hold in the content you upload or publish. To the extent necessary for Diggr to operate the service, you grant Diggr a non-exclusive, worldwide, revocable right to host, store, reproduce, adapt for technical purposes, display, and make available that content within the Diggr service.

This right is limited to what is necessary to provide, secure, improve, and support Diggr, including public display of content you intentionally publish.

Third-party content and app information

Diggr may display app names, icons, App Store links, developer names, and related metadata in order to identify apps and help users recognize them. Such content and any associated trademarks belong to their respective owners. Diggr is not affiliated with Apple or with the listed app developers unless explicitly stated.

Diggr may also include links to third-party websites or services. Diggr is not responsible for the content, availability, or practices of third-party websites or services.

Reporting, review, and removal

Diggr may review, restrict, hide, or remove content, profiles, links, or uploads where there is a reasonable basis to believe that they violate these Terms, applicable law, or the rights of third parties, or where this is necessary to maintain the security, integrity, or lawful operation of the service.

If you believe content on Diggr violates your rights or applicable law, you may contact Diggr using the contact details in the imprint.

Availability and changes to the service

Diggr is provided as an evolving service. Features may be added, changed, interrupted, or discontinued where this is reasonable, for example for technical development, security, legal compliance, operational improvement, or product decisions. Diggr will take the legitimate interests of users into account when making such changes.

Diggr does not guarantee uninterrupted availability. Temporary outages may occur, for example because of maintenance, updates, network issues, security incidents, or factors outside Diggr's control.

Termination and account deletion

You may stop using Diggr at any time. Where account deletion is available, you may request deletion of your account through the app. Diggr may suspend or terminate access, or restrict individual features, where there is a legitimate reason to do so, including serious or repeated violations of these Terms, security concerns, unlawful use, or misuse of the service.

Liability

Diggr is fully liable in cases of intent, gross negligence, injury to life, body, or health, and where liability cannot be excluded under applicable law, including mandatory product liability rules.

In cases of simple negligence, Diggr is liable only for the breach of a material contractual obligation, meaning an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely. In that case, liability is limited to the typical foreseeable damage. Any further liability for simple negligence is excluded to the extent permitted by law.

The above limitations also apply in favor of Diggr's legal representatives, employees, and agents.

Consumer rights

Nothing in these Terms limits mandatory rights you may have as a consumer under applicable law. If you are a consumer residing in the European Union, you continue to benefit from the mandatory provisions of the law of your country of residence.

Applicable law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods, to the extent such choice of law is legally permissible. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection granted by mandatory provisions of the law of your country of residence.

Changes to these Terms

Diggr may update these Terms where this is necessary for legal, regulatory, security, technical, or operational reasons, or to reflect changes to the service. The current version will be published on this page with an updated date.

Press kit and downloads

Press kit materials, if provided, may be used for editorial coverage of Diggr. They may not be used in a way that falsely suggests sponsorship, partnership, endorsement, or authorship. Unless explicitly stated otherwise, Diggr grants no trademark or brand license beyond what is necessary for legitimate editorial use.
